Penalties as per Federal Decree by Law No. 33 of 2021

Article (60) amended by Federal Decree-Law No. (9) of 2024 β€” fines increased from 50,000–200,000 AED to 100,000–1,000,000 AED; clauses on fictitious employment added.

Fine of 20,000–100,000 AED1. Providing incorrect information or documents with the intention of recruiting a foreigner to the State to work therein.Article 59
2. Obstructing or preventing a Worker assigned to implement the provisions of this Decree-Law, its Executive Regulation and the resolutions issued in implementation thereof, or attempting to prevent him from performing his job, whether by using force, violence, or by threatening to use force or violence.
3. Disclosing a work secret that he has had access thereto by virtue of his work as a public servant charged with implementing the provisions of this Decree-Law, even after leaving work.
Fine of 100,000–1,000,000 AED1. Providing employment to a Worker without obtaining a work permit.Article 60
2. Employing or recruiting a Worker and failing to provide him with employment.
3. Making use of work permits for purposes other than those for which they were issued.
4. Closing or ceasing the Establishment's operations without following the necessary procedures for the settlement of Workers' dues.
5. Employing or recruiting a juvenile in violation of this Decree-Law.
6. Any person who has guardianship or custody over a juvenile and agrees to employ him in violation of this Decree-Law.
Fine of 100,000–1,000,000 AED (multiplied by number of fictitious employees)Appointing fictitious employees to circumvent laws regulating the labour market. If this results in the employee receiving benefits from any governmental body, the court shall order the Employer to reimburse the value of financial incentives. Only the Minister may initiate criminal proceedings.Article 60(2–3)
Settlement: min 50% of fine + reimbursementThe Ministry may settle the crime under Article 60(2) at the Employer's request, for not less than 50% of the minimum fine, plus reimbursement of all financial incentives received by fictitiously appointed employees. Settlement closes the criminal case.Article 60(4)
Imprisonment β‰₯ 1 year and/or fine of 200,000–1,000,000 AEDExploiting or misusing electronic powers granted to access the Ministry's systems, or enabling others to do so, resulting in disruption of labour procedures or relations.Article 61
